City Subcontractor Demolished Wrong House

FORT WORTH (CBSDFW.COM) – Imagine driving up to your home – or vacation home – and realizing it’s not there.

It happened in the Lake Worth section of Fort Worth last Friday when a city subcontracted demolition crew took down the wrong house in the 9700 block of Watercress Drive.  The crews apparently demolished the house next door to what was the original targeted property.

“Typical city,” said neighbor Stephen Neumann, laughing.

Neumann ruefully observes this kind of mistake has happened along the lake before and that he keeps his own property spritzed up to avoid any confusion. He was on his way to a charity fund-raiser early Friday and couldn’t figure out what a demolition crew was doing to a relatively well-built home.

“I just seen an excavator tearing that house down and I was wondering why,” he said adding, “It was a pretty good house, it wasn’t all that bad. When this one next door has been needing tearing down for years.” Neuman says he thought perhaps someone was tearing it down to build a fancy new home, but that wasn’t the case. The city calls it a mistake.

The property set for demolition was at 9708 Watercress but what was actually torn down was next door at 9716 Watercress.

Code enforcement was at the demolished home taking pictures and getting new information Tuesday aftenoon in preparation for a meeting to discuss what happened. But no one would talk to CBS 11 News on camera about the mixup until the city investigation is completed.

Off camera, city officials have indicated that the property was vacant and public utilities disconnected before the demolition crew went to work.

Another neighbor, Samantha Farmer feels it could be an understandable mistake, given the condition of some other homes near the one that was demolished.  “To be honest, all those houses up there have been kind of…junky. So I could see how they could have gotten it mistaken for the wrong one.” said Farmer.

The owner of the demolished property actually has a permanent home at Eagle Mountain Lake. CBS 11 has been unable to contact the owner, but it’s expected they’ll be compensated for the loss.

Child In Lake Worth Crash Remembered One Year Later

LAKE WORTH (CBSDFW.COM) – A year has passed since the tragic death of a 7-year-old girl who was run down by an out-of-control driver as she walked out of a Target store, holding her mother’s hand.

Vincent Martinez was behind the wheel of a truck when he struck four people in front of a Ross store, then kept driving and hit two more, including Savannah Deegear, who died at the scene.

The family had just gone back to school shopping.

One year later, friends and family honored the memory of the little girl by releasing balloons into the sky.

“We love her and miss her with all our hearts,” said Mark Deegear, Savannah’s father. It’s been a tough year for the family, despite unconditional support from loved ones.

The family built a memorial garden in Savannah’s name and even received a personal invitation from Jerry Jones to attend a Cowboys game.

Mark Deegear had planned to take Savannah on a daddy-daughter date to a Cowboys pre-season game before she was killed. Jones invited the family to the stadium and personally greeted the family, then gifted them a suite to watch the game.

“He really cared about our family,” Deegear said.

But from tragedy, the seeds of a friendship were planted.

“We have a beautiful friend that we’ve met, her name is Shannon Norton. She, uh, she lost her son in Springtown a couple of months ago,” said Annetta Deegear, Savannah’s mother.

In May, 10-year-old Haven Norton was run over by a school bus, as his mother watched from their front porch.

“We decided that we wanted to help and we felt like we needed to share our story with her because we know what she’s going through,” Mark Deegear said.

From their common experience, the families have forged an unbreakable bond and have helped lead each other down a healing path.

“We just needed to lean on each other,” Annetta Deegear said. “Now we are wonderful friends and she’s with us here today.” One year after Savannah’s death, the playful, loving spirit of the little girl whose life was tragically cut short, is still very much alive.

2 Homes Wrongly Razed In Fort Worth

FORT WORTH (AP) – Demolitions of substandard structures were halted as city officials review why two houses were wrongly torn down this summer and establish new procedures.

A supervisor was put on administrative leave amid a review of the mid-July incidents, the Fort Worth Star-Telegram reported.

Bill Begley, a spokesman for the city, said Wednesday that a city-hired contractor on July 11 tore down two homes on the same north-side lot. The order was to raze just one house that had suffered fire damage, Begley said.

Fort Worth officials discovered that error while investigating the incorrect July 12 demolition of a Lake Worth-area home. Authorities later determined a city crew marked the wrong structure to be razed, as the house next door was approved for demolition by the city’s building standards commission, Begley said.

The same contractor tore down both homes, and the same city code compliance supervisor was over both cases, Begley said. The name of the supervisor was not immediately released.

Begley on Thursday identified the company as Garrett Demolition, Inc. A message left with the company was not immediately returned.

The city plans to review all previous demolition cases involving the contractor and supervisor and install more safeguards for “documentation and accountability,” Begley said.

“Each step has to be approved before you move on to the next one,” Begley said.

The staff will present the revised rules to the Fort Worth City Council in September for review. Begley said no council vote would be needed to implement the changes.

5 Seriously Burned In Lake Worth Car Fire

LAKE WORTH (CBSDFW.COM) – At least three medical helicopters were sent to the scene of a car fire in Lake Worth.

MedStar officials say five patients, 4 males and 1 female, had to be taken to Parkland Hospital in Dallas. Four of those five were transported via helicopter.

Officials say all of the injured were seriously burned when the car burst into flames, some over 40 to 50-percent of their bodies.

Only one vehicle was ablaze on NW Loop 820 and Azle Avenue. It isn’t known if the vehicle crashed and then caught fire. A witness told a CBS 11 News crew that they saw the interior of the car burst into flames.

The Lake Worth Fire Department was first on the scene and the Fort Worth Fire Department assisted.

Officials have not released the identities or ages of those in the car at the time of the crash.

Deadly Weekend On DFW Area Lakes

LEWISVILLE (CBSDFW.COM) – It has been a deadly weekend on DFW area lakes as people flock to the water to celebrate the Labor Day holiday.

On Sunday night, a 15-year-old boy and his 23-year-old uncle drowned at Lake Worth. According to authorities, the boy fell off a ledge while wading in waist-deep water, about 75 yards off shore. When the uncle attempted to save the boy, the uncle was pulled under as well. Neither victims were wearing life jackets.

“Swimmers should always be accompanied by someone who can swim and possibly have a safety vest with them,” said Carol Jones with the Fort Worth Fire Department.

Meanwhile, the search continues at Lake Lewisville for a 37-year-old father from Frisco who went under on Sunday while trying to rescue one of his kids. According to the Game Warden’s office, the father was tubing with his son when the boy fell off the tube. The father, who was not wearing a life jacket, went to save his son. The father never surfaced.

The child, who was wearing a life jacket, is okay.

Search teams are combing over a 10 to 14 acre area in the east-central part of the lake. “It’s very frustrating,” said Dep. Johnny Peters with the Denton County Sheriff’s Office. “It actually hits home. We are out here trying to do what we can, and when we found out that someone is missing or has drowned, it hits us all.”

A third incident occurred on Friday, when a 33-year-old Mesquite man went missing after falling off of a party boat. Divers have yet to recover his body and continue to search.

Game Warden Lt. Jennifer Kemp said, “If we can get the point across to people to wear your life jackets. They’re called that for a reason; it’s there to save your life.”

Rescuers Recover Body Of North Texas Drowning Victim

NORTH TEXAS (CBS 11 NEWS) – It’s been a deadly weekend on area lakes. Two people drowned in Lake Worth. Officials in Lewisville have confirmed that two people drowned in Lake Lewisville and pulled their bodies from the water Monday afternoon.  A tubing accident on Joe Pool Lake also critically injured a boy.

Lewisville Fire and Rescue teams used sonar to scan the lake as they began their third day of searching for bodies on Monday.  Late in the afternoon, the body of George Rodriguez was recovered. The 33-year-old had fallen off a double-decker party boat Friday. Within a few hours, a citizen found the body of the second drowning victim.  The man who had been boating with his wife and children Sunday when he fell off an inner tube that was being pulled behind the boat. His name had not been released.

Two other people,  16-year-old Javier Zacarias and his 24-year-old uncle Juan Zacarias drowned in Lake Worth. The pair had been wading. According to police, the teen, who couldn’t swim, slipped into 12 feet of water. The uncle, who couldn’t swim either, tried to save him and also drowned. Police say because of low water levels they were able to wade 75 to 100 yards off shore.

Whether wading or boating, lake-goers are seeing new hazards as lake levels drop. “It’s usually up a lot more than this. It’s usually up here to the rock,” lake visitor Regis McBride said pointing. “I think you’d say eight foot down? About eight foot down from the bank.”

The low water levels have been especially dangerous for boaters.

One man was boating on Lake Ray Hubbard when he ran onto an exposed sand bar. He and his four daughters had to be rescued.

Big sailboats are especially at risk because they need deep water to operate.

Each new day exposes new hazards on the water. “Mostly trees,” boater Eric Kihl noted. “Some of the tires have come loose from the wave break. And things we’ve never seen before are now sticking up out of the water.”

Invasive Zebra Mussels Found In Another Texas Lake

NORTH TEXAS (CBS 11 NEWS) – A pesky problem is spreading into more Texas lakes. Invasive zebra mussels first showed up in 2009 at Lake Texoma.

Now, the Texas Parks and Wildlife Department confirm zebra mussels have spread to Belton Lake, about 130 miles south of Fort Worth. The species is also suspected of living in two additional North Texas lakes – Joe Pool and Lake Worth.

While no actual muscles have been found in either lake, just the fact chemical traces of them have been captured have some worrying.

“That’s going to be a problem,” said Susan Hurst, as she sat chatting with members of the Lake Worth Sailing Club. “I hope it’s not that involved.  I hope we’re catching something early so it can be resolved.”

Tests found what Texas Parks and Wildlife call a ‘weak’ DNA sample.  That means they have not found actual mussels in the lake. The DNA picked up in water samples may have been traces of the mussels brought in on a boat from another lake. The genetic material could also be there because there may be a small cluster of mussels in the water.  No one is sure.

A Parks and Wildlife release stated:

“…the fact that the presence of zebra mussels could not be confirmed by other methods means that these two lakes should be considered ‘suspect’ until further testing.”

To even have the lake as ‘suspect’ for harboring zebra mussels causes uneasiness around the waterways.

The mussels reproduce rapidly and are notorious for the damage they cause.

Boats kept in the water could have problems with mussels on the hulls and in the bilges.

But the biggest worry is for the intakes that pump water for the area’s water supply.

Mussels growing in the pipes can cost millions of dollars to clean and repair.

“We do continue to do the monitoring,” said Fort Worth Water Department spokesperson Hilda Zuniga. “And we do pay close attention to the intakes at the lake just to make sure that there’s nothing there.  And at this point we can say there’s nothing there.”

Tentative Deal In Wrong House Demolition

FORT WORTH (AP) – The city of Fort Worth has reached a tentative $102,500 settlement with a property owner whose three-bedroom house was mistakenly torn down last year.

City spokesman Bill Begley told the Fort Worth Star-Telegram that subject to City Council approval, the city has agreed to pay $62,500, the contractor agreed to $15,000, and the contractor’s insurer agreed to pay $25,000.

The potential settlement will go before the council in about two weeks.

The home near the shore of Lake Worth was torn down on July 12 after a city crew marked the wrong house for demolition. It should have marked the house next door.

The day before, the same city-hired contractor incorrectly tore down two homes on a lot instead of, per its work order, only the fire-damaged one.

Man Arrested After Patrol Vehicles Shot

FORT WORTH (AP) – A suspect has been arrested as North Texas police investigate gunfire that damaged three parked patrol vehicles while the officers were off-duty.

Mansfield city jail records show 19-year-old Luis Felipe Gallegos was being held Tuesday on a deadly conduct charge related to discharge of a firearm. Online records don’t list an attorney for Gallegos, whose bond was set at $3,000 following his arrest last Thursday.

Fort Worth police say nobody was hurt in three apparently related incidents.

A rifle stolen from a Texas Department of Public Safety trooper’s patrol car June 15 has been recovered.

Officers on June 16 answered a criminal mischief car about a police car hit by gunfire.

Investigators the next day learned that a Fort Worth police car, parked in Lake Worth, was peppered by gunfire.

Man’s Body Pulled From Lake Worth

FORT WORTH (CBSDFW.COM) – Dive teams recovered the body of an adult man at Lake Worth Saturday evening.

The Fort Worth Fire Department received a call reporting that a swimmer had gone missing at the lake around 5 pm.

Emergency responders were first on the scene, followed by a dive team, which pulled the man’s body from the lake shortly before 6 pm.

The man was visiting the lake with his family. His name has not been released, pending identification from the Tarrant County Medical Examiner’s Office.

North Texans Welcome Recent Rain

LAKE WORTH (CBSDFW.COM) – Every drop of rain.  Every bit of melted run off has been pouring water into parched North Texas lakes.  The Texas Water Development Board reports Dallas area lakes were up 4.4% as of Monday morning.

“Oh! I love it!” exclaimed Cheryl Wright who lives on the shore of Lake Worth. “It’s what we need!”

Lake Worth is a shallow lake even when it’s full.  Monday morning it was three feet below normal levels even though the lake has risen from 64% to 70% of capacity in the past month.

“Well, you can kind of see where the water level usually is,” Wright said as she pointed to water marks on a pier’s pylon three feet above the water line.

The recent rain, sleet and snow is welcomed by lake residents. For months, they struggled to cope with receding. waters.

“When you live out here you learn,” Wright said. “We have the little a steppingstone bricks we set out there in front of the boat, it’s a pontoon boat, to where you walk on top of the bricks to get in and out.”

“The stumps, every time we take the JetSki out you hit the stumps,” said Chris Hickman who lives next to Wright. “We got stuck in the boat and everything.”

But, finally, the water is on the rise. People are grateful for the water, but they want more.”

“I can still see stumps though, so, it’s good but we could still use more,” Hickman laughed.

Woman Claims She Was Fired From Starbucks During Cancer Struggle

LAKE WORTH (CBSDFW.COM) – A Lake Worth woman has filed a federal grievance against her former employer, Starbucks.  Barbara Humphries tells CBS 11 News, her grievance isn’t against her former co-workers.

She says they’re sympathetic, but it’s corporate Starbucks that she says fired her while she is still struggling with cancer.

On her 31st birthday last May this single mother of two got a diagnosis that women dread; breast cancer.  “It’s terrifying,” she told CBS 11 News adding, ” It’s the scariest thing I’ve ever done.”

And months later, following a double mastectomy, Barbara Humphries received another dire diagnosis that cancer had spread to her bloodstream.   She missed nearly a year of work, using up all of her medical leave, while enduring two different chemo regimens.

And then she received word that Starbucks’ insurance company was denying her request for an extended leave of accommodation unpaid leave.  “I feel like every time I get ahead something brings me down and it’s not fair,” she said.

A little more than three weeks after that request was denied — she claims a representative from the Starbucks corporate office called with the worst news possible.   “Her exact words were, ‘It’s with a heavy heart that I have to tell you we’re going to terminate your job.'”

Angry and upset, Humphries filed a federal EEOC disability discrimination complaint against Starbucks, ” Because I dedicated so many years of my life to them I thought … I don’t know, it’s a lot (of time).”

Starbucks refers to its employees as partners, and in a prepared statement told CBS 11,

Out of respect for our partners’ privacy, we do not publically disclose specific details about current and former partners’ individual employment.

The company also said it wasn’t prepared to discuss the EEOC complaint.

Humphries says she lost all the company-supported insurance on herself and her kids.  She did extend her medical insurance through COBRA, but it’s nearly three times what it cost while she was employed.   “I kind of felt obligated to take the COBRA, because what else are you going to do when you have hundreds of thousands of dollars of medical bills?”

And she still faces radiation for the stubborn cancer cells still in her system.

Some acquaintances with the Tarrant County Libertarians are holding fund-raiser on her behalf next week.   It will be Thursday in Bedford at the Twisted Root form 7-10pm.

Missing Teen Found Safe After Day-Long Search

LAKESIDE(CBSDFW.COM) – A 13-year-old boy is found safe after being missing approximately 28 hours.

An Albertsons manager recognized William Cooper in his store as the missing child and called police Monday night.

Police say they will be questioning the teen who was found about four miles from Lake Worth where he’d been fishing.

His parents looked for him Sunday night but didn’t call police until Monday morning.  Lakeside police say the boy had never gone missing or run away before.

Cooper’s bicycle and a jacket were found about two blocks from his house near Lake Worth, but there had been no sign of him all day Monday until authorities confirmed the good news around 8:30pm that he was found apparently uninjured.

Game wardens and city marshals spent hours today searching that lake.  Volunteers from the Search One Rescue Team provided dogs trained to track humans & locate human remains.

“It’s a great outcome.  Anytime you find a 13-year-old it’s a good outcome,” says Lakeside Police Chief Lee Pitts.

Police showed up with the boy’s father to pick him up.

Fort Worth Closing Lake Worth Boat Ramps Tonight

FORT WORTH(CBSDFW.COM) – The City of Fort Worth will close the boat ramps at Lake Worth Thursday night because of projections the lake could reach an elevation of 596 feet Friday morning. At that elevation, boats wakes could cause flooding in some homes and some boat docks could be under water, creating a navigation hazard.

Fort Worth Marshals will close the ramps sometime overnight, giving anyone on the water this evening the chance to get their boats out.

Tarrant Regional Water District informed the city late Thursday afternoon it is now releasing water at a rate of 5,860 cubic feet per second from Eagle Mountain Lake to reduce that lake’s level.

The last time the boat ramps were closed for this reason was in June 2007.

Residents around the lake that have boats are being asked to keep the boats off the water while the boat ramps are closed.

No Boats Allowed On Lake Worth

TARRANT COUNTY(CBSDFW.COM) – The lake level is so high the wake from a boat would send water right into nearby homes Friday night.

“A lot of dang water,” says lake resident Chris Rainone.

A lot indeed.  Enough to float his neighbor’s boat into Rainone’s backyard.

“It was out past that second big tree. Now it’s 75 feet up into the yard,” explains Rainone.

Everywhere you go on Lake Worth, people tell you how things were before the lake was raised almost two feet over its maximum level.

“On a normal day this beach goes all the way down to the end of the steps which is grassy,” says boat club member, Suzie Whitcomb.  “Below that we have a sandy beach.”

A couple of weeks ago lake levels had beached boats at the Lake Worth Boat Club.  The boat ramp is now under water.

“It’s coming up higher to where they can, if you have a wake on this lake, you can flood and wash water in and we don’t want to do that here,” says Whitcomb.

All that water has left people like Rainone planning on a quiet, wet holiday weekend.

“I’d like to have people over,” says Rainone.  “It’s going to rain all weekend I can’t really do anything. Nice lakefront lot and you can’t do anything with it?

Firefighter Hurt During Lake Worth Cliff Rescue

LAKE WORTH (CBSDFW.COM) – A firefighter was hurt early Friday morning while rescuing a man who fell about 40 feet down an embankment at Lake Worth. It happened at about 6:00 a.m. in the 8300 block of Cahoba Drive, on the east shore of the lake.

Emergency crews with the Fort Worth Fire Department and MedStar were trying to reach the 26-year-old man and get him back up to the land above. The man was reportedly hiking with a woman in the dark when he slipped down a steep slope. This was not along any designated walking path.

The victim was originally said to be in critical condition, unconscious with multiple fractures. He was carried to Harris Methodist Hospital in Fort Worth by air ambulance. Officials have now stated that, despite his numerous injuries, the man is expected to survive. He was released from the hospital later Friday morning. His name has not been released.

During the cliff rescue efforts, one firefighter fell about 12 feet and suffered a broken ankle while trying to reach for the equipment being used to retrieve the fall victim along rough terrain. MedStar took him to Harris Methodist Hospital in Fort Worth as well for treatment. He, too, was released from the hospital later Friday morning.

“The hard part is getting out, especially when you have a patient who’s injured,” said Kyle Clay with the Fort Worth Fire Department. “If you can imagine picking up 200 pounds and climbing a hill with four other people, it’s hard to do. That is what they were trying to do, get up the hill, and one of the firefighters slipped and fell.”

The firefighter was later identified as Lt. David Klemencic, a 23-year veteran of the Fort Worth Fire Department.

Both patients had to first be removed from the scene by boat. They came ashore at the Cahoba boat ramp, located off to the southwest of where the fall took place.

15 Injured In Vehicular Accident Chain Reaction

LAKE WORTH (CBSDFW.COM) — A vehicular accident created a chain reaction on Saturday injuring 15 people.

The accidents happened at the intersection of Azle Avenue and Loop 820, according to MedStar.

The first accident left a 13-year-old girl in serious condition and a 30-year-old woman in critical condition, MedStar said. The 30-year-old was flown to Texas Health Harris Methodist Hospital, while the 13-year-old was ground-transported to Cook Children’s Hospital.

The chain reaction of accidents behind the first one injured 13 people, MedStar said. One was transported from the scene, while the other 12 were treated there and released.

Adult Steals Halloween Decoration Off Porch

LAKE WORTH (CBS11) – A Lake Worth family says an adult trick-or-treating with a group of children took more than just candy on Halloween night.

“He stepped off the porch, went back on the porch grabbed the deal off, and walked down the sidewalk laughing about it,” says homeowner Brandon Honea.

Honea’s home security camera system caught someone dressed in a baseball cap, hoodie and tan boots, swiping a toy skeleton that decorated the home.

The act was done in the presence of other children accompanying the thief. In the video, the person appears to be carrying a pumpkin filled with candy for a toddler wearing a dinosaur costume.

“The girlfriend or the wife or whoever, had a toddler in their hand. They had a younger kid with them,” Honea explains.

While the price of the decoration is negligible, Honea says it was important to his 6-year-old son.

“I felt worried because no one stole something from our house before,” the child said.

Seth Honea was handing out Halloween candy to trick-or-treaters for the first time this year. His toy skeleton has decorated the home for the last 3 Halloweens.

Honea says its forced him to explain the person’s actions to his children.

“I showed him the video and he said why would an adult steal a toy? A decoration?”

Lake Worth Closed To All Boating Activities

FORT WORTH (CBSDFW.COM) — Lake Worth and its city-operated ramps are closed to all boating activities.

The City of Fort Worth said the lake has risen about 4 feet in the past 48 hours: At 11 a.m. Saturday, the lake elevation was 596.61 feet, more than two feet above the spillway. At this elevation, boat wakes can cause flooding in some homes and some docks could be out-of-sight underwater.

Residents around the lake with boats are being told to keep their boats off the water while the ramps are closed.

TARRANT COUNTY (CBS11) – What a difference a couple of years make.

It was this time two years ago Dallas-Fort Worth was suffering through a huge ice storm and fighting its way over cobblestone ice on bridges. But out at the Lake Worth today people were not wearing heavy coats and some are literally cashing in on the sunshine and temperatures in the seventies.

“Mid 70s here in Texas?” picnicker Ken Taff laughed. “No, not in the middle of December!”

This is NOT a normal December day.

“It’s usually a lot colder,” said avid Lake Worth fisherman Richard Royall. “But it is warm and the fish are biting!”

And there’s one guy thankful these people are hitting the lake like its spring time.

And that thankful person is convenience store and bait shop worker Ryan Underwood. He’s suffered through 40 days with Lake Worth closed due to high water this year.

“When the lake is closed it kind of slows down business,” Underwpod said. “People don’t really want to get out there, don’t want to spend money on bait and all that just to catch a fish. When the lake is closed it hurts us.”

Underwood is in a cluster of stores right next to the lake. The store benefits every time a boater fills an ice chest or a picnicker stops by.

“We just stopped up there at that little convenience store and bought some barbecue sauce and everything,” Taff said.

“Oh yeah, it helps them,” Royall said. “Buying bait, worms, shad.”

Businesses like Underwoods are hoping for a lot of warm winter days to offset the soggy spring and fall.

“It should help us and pick up that’s what we’re hoping for,” Underwood said.
